"In the name of God Amen, I Anthonio Phillipps of Nether Teane in the Countie of Staffs yeoman, Although sicke & weake in bodie, yett of good remembrance thankes be gyven to god for the same, doe heereby make, and declare, this my last will and testament, in manner and forme following, and first I doe comend my soule into the safe keeping of my Lord and Saviour Jesus Christ, by whose deades and sufferinges I hope to bee saved, renounceng all merritte in my selfe, or helpe of mankind, and my bodie to deserve buryall, All the oversight of myne executors, and as for that worldlie estate, the Lord hath lent mee I dispose of it as followeth, first I give to the poore w(ith)in the Hamlett of Nether Teane iiijs iiiijd to bee disposed of by myne executor;
Item whereas by conveyance I stand seized of half of the tenement wherein I nowe dwell, tomee and my heyres for ever, My will and minde is that Elizabeth my loveing wiffe shall have and enjoy all my said pte of the said tenement during her naturall life. If she so longe continue sole and unmarryed and that from and after her second marriage shee shall have two ptes in three ptes devided as the same during her natural life.
Item my mynde and will is that from & after the oppiraton or determination of my said wyves said estate sente all or any of my said lands or or hereditaments that the_wesoorth I doe heereby will devise give and bequeath unto my brother in lawe Thomas Arnold and to my brother Francis Phillipps and to their heyres and to the heyres of the survyvor of theym. The possession & reversion of all my ___ said lands and hereditaments and of all other my lands tenements and hereditaments whatsoever uppon especiall trust and conseente that they shall and will out of the same all their discretione raise and _ide the sum of One Hundred and fourtie pownds towarde the portons and & formts of Francis Margerie and Marie my younger children and the residue to remayne come unto Richard Phillippes my eldest sonne my desire intent that my said eldest sonne shall and may redeeme the said lands uppon payment of the said seavenstone pownds according to the appoynment of my said brethyren (if he so will) My mynde & will futher is that if my said wiffe shall or lawfullie may bee endowed of the third pte of the other halffe of the said temem't that then shee shall have onely a third pte of my said halffe pte of the same; My true meaneing beeing that shee should have a full third pte; of the entire tenem't for her may_te_am_o after her second marriage and noe more
Item I doe give and bequeathe unto my said brother Thomas Arnold and Francis Phillipps the some of One Hundred pownds; The same to be payd whin one yeere next after my decease and to be by thym disposed of for the use and benefitte of my said three younger children, as shall seme to theym best, My will is that if Richard my eldest sone die, that then the legacie by this my will gyven to , or to the use of my sonne Francis, shalbee equallie devided betwixt my two daughters; and further my will is that if any of my younger children die before any portion to theym payd; that then the bequest devised unto, or to the use of the ptie so dying shalbee disposed of, to these that shall survive;
Item the rest of my goods, and personall effects whatsoever, not formerlie disposed of; I give and bequeath to my beloved wiffe therew'th The offer to enable her, to keepe and bring upp my children, and I doe make and ordayne my said wiffe, sole and inlie executrix of this my last will and testam't, and in witnes that this is my last will & tesam't, I have heereunto putt my hand and seale the seaven and twentyth day of May; In the neeneteenth yeere of the raiyne of the most gracious Souvrigne Lord Charles; by the grace of God as King of England Scotland France and Ireland Defender of the faythe."
