[14161] Samuel was broke upon his marriage to Julia. She on the other hand, had inherited her father's estate, her mother was dead, and her brother had also passed on. Julia sold one negro girl (Jane) to pay Samuel's debts, and another, along with her beds and other property, were conveyed into a trust for Julia. This is laid out in an Indenture ("a formal legal agreement, contract, or document") signed by Samuel, Julia and her trustee, John Horner.

This Indenture made and entered into the 8th day of October 1832 between Samuel Ciaggett of the first part, John S. Homer of the second part and Julia Ciaggett wife of the aforesaid Samuel Ciaggett and formerly Julia Sanford formerly of the County of Prince Wm. and the said Samuel Ciaggett and Julia his wife now of the County of Fauquier State of Virginia. Witnesseth: that whereas among other considerations the said Samuel Ciaggett and Julia Sanford entered into certain articles of marriage agreement signed and recorded in the County of Prince William before their intermarriage in the year 1827 by which agreement it was covenanted by and between the aforesaid Samuel Ciaggett and Julia Sanford a certain James Fewell being the trustee, that all the interest, title, claim and demand in law and equity of her the said Julia Sanford now Julia Ciaggett in and to the estate of her deceased father, Thomas Sanford of the County of Prince William as also all her the said Julia's interest, claim and demand in and to the estate of her deceased Brother Thomas Sanford should be settled upon and secured to her the said Julia and her heirs forever, free from the control, debts. forfeitures of the said Samuel Ciaggett then or to come; and whereas after the aforesaid marriage and at the sale of the estate of the aforesaid Thomas Sanford a certain negro girl by the name of Delilia, the property of the estate of the aforesaid Thomas Sanford the brother aforesaid was brought in by the said Samuel Ciaggett with the funds secured by the aforesaid recited articles of agreement. To wit: by the distributive share in part of the aforesaid Julia in and to the estate of her deceased Brother Thomas: at the time of the aforesaid sale the Trustee to said articles substituted by an order of the County Court of Prince William. To wit: James Hampton being then dead, which said negro girl Delilia being the proceeds of the said Julia's interest and distributive share in the estate of the said Thomas Sanford her deceased Brother in aforesaid and it being just and equitable that the said negro girl Delilia should be placed on the same ground as the fund which bought her, should she not already be in that condition to effect the same to all intents and purposes in the same manner and to the same intent and according to the provisions of the aforesaid recited articles recorded as aforesaid in the County Court of Prince William and referred to by this deed and for and in consideration of the sum of one dollar in hand paid by the said John S. Homer to the said Samuel Ciaggett, the receipt whereof the said Samuel Ciaggett hereby acknowledges, bargains and sells, aliens, transfers and conveys unto the said John S. Homer, all the right title, interest, claim and demand of him the said Samuel Ciaggett in and to the said negro girl Delilia in law and equity to have and to hold her the said negro girl Delilia and her future increase to him the said Homer and his heirs forever. ln trust for the benefit of the aforesaid Julia Ciaggett formerly Julia Sanford and the heirs of her body begotten by her husband Samuel Ciaggett and in case of the death of the said Julia without issue living the said Samuel Ciaggett surviving, then the negro girl Delilia and her increase shall be the property of the said Samuel Ciaggett and his heirs forever.

And for a further consideration as moving the said Samuel Ciaggett in the premises, to wit: that the said Samuel Ciaggett soon after the intermarriage, with the said Julia sold and transferred a certain negro girl by the name of Jane, the proceeds of which sale was applied to the payment of the individual debts of the said Samuel. When it was agreed by and between the aforesaid Samuel and Julia that because of said last recited sale, the said Samuel Ciaggett would make over such interest in any that he might have in and to the said girl Delilia in lieu of the said negro Jane, solo for his befit as aforesaid. In testimony, whereof the parties to this deed, hereunto set their hands and seals, the day of year first above written.

The words "John S. Horner’ between 2nd and 3rd lines interlined before signing, so also the word ‘Horner" in last line on second page and also the words "John S. Homer" between 10 and 11 lines from bottom of 2nd page, the erasure of the I 7th line in 3rd page also the erasure of 7th and 8th line on 1st page.

[54] In 1860, the value of her real estate is given as $8,190, and her personal property as $19,635. Since slaves were considered personal property, this is probably a good part of her worth at this time. In 2002 this would have been equivalent to $533,085. After The War of the Rebellion, the slaves had a value of zero.

Julia's will was probated in Prince William County, Virginia. All it says is that she leaves everything to Thomas J. Claggett, her son, who moved to Illinois after she died.

[1756] Obituary

Dec. 3, of paralysis, Mrs. Fannie C. Francis, wife of Wm. Francis deceased, at the home of her daughter Mrs. Nathanial Harrison near Doddsville, Fauquier county in the 72nd year of her age. She had been in failing health for a number of years which developed in heart trouble and paralysis from which she died. She was an affectionate mother and a kind neighbor, a warm friend and was loved by all who knew her. In early life she gave her heart and life to God and connected herself with the Broad Run Baptist Church, from which she was laid to rest in Warrenton Cemetery.

Rev. F. R. Boston of the Baptist Church officiating at the burial services, there to await the final summons, and to received from the Master the plaudit of, "well done thou good and faithful servant." She leaves behind her in this vale of tears, three daughters and six sons, and a number of relatives who deeply feel their loss and mourn her death, but kindly cherish her memory and hope to meet her in the bright beyond. The deceased was born and reared and lived most of her life at or near New Baltimore, Fauquier County, and was the daughter of Samuel and Julia F. Claggett of that place and grand daughter of Dr. Claggett of revolutionary fame.

In the 1850 census, Fannie Clagget Francies was living next to her mother, Jula, and was married to William Francis. William Francis' parents, Andrew and Elizabeth, lived on the other side of Fannie and her husband.

Obituary

Mrs. Ann E. Beasley died Monday morning, Jan. 24th, at 5 o'clock, at the home of her daughter, Mrs. Pollard Strothers near Lexington, and was laid to rest in the Lexington cemetry [sic]. Her husband died in Virginia in October 1897.

Deceased was a daughter of Samuel Claggett of Virginia, and was born in New Baltimore, Fauquier Co., Va. in the year 1835; aged 62 years and about 10 months. She was married to Thos. W. Beasley in 1851. To this union were born eleven children, eight of whom survive her besides two sisters who are now living in Virginia; two brothers, T. J. and B. F. Claggett, of this city, to mourn her loss. Mrs. Beasley was a half sister to Jas. A. and S. R Claggett, deceased. Rev. Myer, Pastor of the United Brethren church of Lexington, delivered a most touching and beautiful funeral sermon to a large concourse of friends and relatives. Her daughter, Mrs. Walling, from Washington, D.C. arrived, but too late to see her mother alive.

Deceased united with the Episcopalian church thirty years ago and was a faithful member till death. Chicago, Washington City and Virginia papers please copy.

The pall bearers were Samuel Johnson and Horace Claggett, James, Luther and Samuel Beasley, the last three her sons.

[659] The 1898 obituary for Ann Claggett says that B. F. Claggett is living in Lexington at the time of Ann's death.

According to the 1880 census, Benjamin was a farmer in Lexington, Illinois. He was also present in the 1900 census. In 1900 his name was given as "Frank" and his occupation was landlord. He had probably rented out his farm by then.

[1971] The 1898 obituary for Ann Claggett says that Thomas.Johnson Claggett is living in Lexington at the time of Ann's death.

The funeral of Mr. Thomas J. Claggett was held at his late residence at 2. p. m. on Wednesday of last week. The attendance was very large, demonstrating the esteem in which he was held a by his neighbors and acquaintances. As was said in the paper, last week, Mr. Claggett had been in rather poor health for the past seven years, but this winter he had been about as usual, was able to be out of doors and, even went to town a few times.

About a week before his death he was taken with the grippe, but there was no apprehension of danger, and his death came as a great surprise to his family.

Mrs. Claggett was in Chicago visiting her daughter, Mrs. Nannie Roy, but was herself taken quite seriously sick and was confined to the bed when word came of her husband's illness. To her very great sorrow she was not able to be with and minister to his comfort during the closing days of his life. But however every thing was done for him which medical skill and the loving bands of faithful children could devise.

The Rev. J. E. Connor officiated and preached a very comforting and helpful sermon. Misses Maggie Shade and Laura Rent and Dr. Covey and A. H. Scrogin sang, Miss Alta Williams was organist. The bearers were Messrs E. H. Hyneman, John Langstaff, J. E. Covey, Harmon Hefner, James Woodard all of Lexington, and Wm. Hursey of Normal. The body was laid to rest in the Lexington cemetery.

Thomas J. Claggett was born in Fauquier County, Va., June 1, 1841. Died at his home near Lexington Ill., Monday morning Feb. 4, 1901, aged fifty-nine years, eight months and three days. He married Miss Columbia Claggett, Aug. 5, 1861. To them nine children were born, two sons and seven daughters. Of these four only survive, viz: Mrs. [Emily] Emma C. Hefner of Lexington, Ill., Mrs. [Anne] Nannie Roy, of Chicago; Miss Minnie Claggett and Mr. S[amuel] C. Claggett, of Lexington. These with their widowed mother mourn the departure of their loved one to the other worId. Mr. Claggett leaves also a [half-]brother Mr. F. [Benjamin Franklin "Frank"] Claggett, and two [half-]sisters, Mrs. [Frances "Fannie"Caroline] Wm. Francis, of Belton, Va., and Mrs. Julia [Catherine Claggett Beasley] Kirby, of Aon, Va., Mrs. S[anford]. R. [Nancy Terry] Claggett, a sister-in-law, and other more remote relatives.

Mr. Claggett and family moved to Illinois in [February] 1879. For the last nineteen years he has resided in this community. He was known to all as an industrious man, a good neighbor, a loving husband and a kind father. For the last seven years his health has been poor. Last spring he gave evidence of being near the end of his earthly career. Again in the fall be was taken worse but recovered sufficiently to get up and go around. One week ago Monday he was again attacked and it soon became apparent that his end was near. He departed-this life Monday morning, a few minutes before eleven.

I have known the departed for over a year and during that time have been in the home repeatedly. While be was sick last spring and again this fall I Visited him, and both times he himself requested that I should lead in prayer.

On Monday morning I talked to him in regard to his prospect and he declared that he wan resigned and ready to go, that he expected soon to be in that home where there is no sickness or pain or death. He said moreover, that he had made his peace with God some three years ago. He had also made such arrangements as he wished in regard to his funeral services, and even selected the text used this afternoon. It is our prayer that God may comfort the widow and fatherless, the brother and other friends as he only can.

[662] In the 1860 census, Julia and her one year old son William A. are living with her mother in Fauquier County. She married her first cousin James D. Kirby eight years later.

Mrs. Julia C. Kirby, widow of the late Captain J. D. Kirby, of the old [Co. K, 17th VA Inf.,] Warrenton Rifles, died at her home in Warrenton, Va., August the first, 1921. Mrs. Kirby was born at Snow Hill near New Baltimore seventy-eight years ago, and was the daughter of Colonel Samuel Claggett and his wife, Mrs. Julia Sanford Claggett. ln 1857 she married Mr. William Beasley, of Culpeper county and went on a bridal tour to California in search of gold. Her husband dying there eight months after arrival she was compelled to return to Virginia, and has always made her home here since.

In early womanhood she was converted under the preaching of Rev. W. D. Thomas and was baptized by him into the Broad Run Baptist church, and was a faithful and consistent member. In 1868 she married Captain Kirby and making Warrenton her home moved her membership to the Warrenton church. Mrs. Kirby leaves five sons and one daughter to mourn her loss; William A. Beasley, of Colorado, James D. and Walter Kirby, of Washington. John and Ralph S. Kirby and Miss Constance Kirby of Warrenton, besides many relatives in this and adjoining counties.

She was a devoted mother, a good neighbor and was loved and respected by many friends. She was quietly laid to rest in Warrenton cemetery August One third, Rev. H. L. Bivens, of the Methodist church, offciating.

    Marriage Contract for Samuel Claggett and Julia F. Sanford

    This indenture tripartite made the 8th day of May in the year of our Lord one thousand eight hundred and twenty seven between Samuel Clagett of the County of Fauquier of the first part, Julia F. Sanford of the County of Prince William of the second part and James Fewell of the third part. Whereas a marriage is shortly intended to be had and solemnized by the permission of God by and between the said Samuel Clagett, and the said Julia F. Sanford: and whereas the said Julia F. Sanford under and by virtue of the last will and testament of her father Thomas Sanford and by the death of her mother the late Kesia Britton and of her brother Thomas Sanford is entitled to a considerable personal property consisting of one morety [sic] of the slaves mentioned in the said fast will and testament and the increase of the female slaves in the said will mentioned, and is also possessed of the following household and kitchen furniture.

    That is to say, two beds and furniture, one side board, one table and some chairs, and whereas it hath been agreed by and between the said Samuel Clagett and Julia F. Sanford that the aforesaid property should be so settled before marriage as to prevent the said Samuel Clagett from acquiring my title or interest therein by virtue of the intended marriage and for the purpose of affecting that object the said Julia F. Sanford doth by this Indenture and for the consideration of one dollar to her in hand paid by the said J. Fewell dispose of and transfer to the said James Fewell all the right title and interest in the property above mentioned. To have and to hold the said personal property unto him the said James Fewell his heirs Executors administrators or assigns.

    Nevertheless for the following uses and purposes, to wit, that the said James Fewell his heirs Exors etc shall permit the said Julia F. Sanford to use the said personal property and receive and enjoy the hires of the said staves and personal property is in no wise to be considered as the property of the said Samuel Clagett or subject to his management and direction and the said James Fewell his heirs Executors etc shall annually pay over the hires of the slaves hereby conveyed to the said Julia F. Sanford her heirs exors or assigns to be appropriated to her exclusive use and benefit. It is understood that this trust estate is created to secure to the said Julia F. Sanford the aforesaid property during her marriage therefore if the said Samuel Clagett should die, living the said Julia F. Sanford, that then and in that event the trust is to cease and she is to have the said property in the same manner as she possessed before the signing sealing and delivery of this Indenture and in the event of the said Julia F. Sanford's dying before the said Samuel Clagett my appointment or disposition which she may choose to make of the aforesaid property by will or by any writing in the nature of a will shall have full effect and she hereby reserves to herself the right to make such disposition or appointment or if she dies without making my such will or writing in the nature of a will her rightful representatives shall possess and enjoy the said property free of this trust and incumberance. In testimony whereof the parties have hereunto set their hands and affixed their seals the day and year aforesaid.
