[14169] Charles County Land Record Book O#3, 1765-1770; Page 607, Aug 3, 1769 from Robert Horner of CC, gent, to Richard Brown of St Mary's County, Clerk, Thomas John Claggett of Calvert County, Clerk, and Cuthbert Bullitt of Prince William County, Virginia. In May [blank day], 1758, at CC, for and in consideration of a marriage then shortly to be had between sd Robert Horner and Ann Clagett, daughter of Gustavus Brown, Gent, of CC, now decd, sd Horner, in consideration of the fortune he expected to receive with the sd Ann and for a provision for sd Ann and her issue which he should have by sd marriage, entered into the following contract and agreement with sd Gustavus Brown for the use of sd Ann, to wit, whereas a marriage is intended between sd Horner, merchant, and sd Ann Clagett, daughter of Doctor Gustavus Brown and widow of Samuel Clagett, late of CC, Clerk, & whereas before sd Ann married Mr. Clagett, an agreement was entered into between Mr. Clagett and Gustavus Brown, whereby a provision was made for the security of sd Ann and her issue, if any. That agreement was recorded in CC. Sd Gustavus and Robert, in order to secure sd Ann and her son, Samuel Clagett, agree that whatever money, goods, chattels, or lands may come to ad Robert in right of the child of sd Ann and Samuel Clagett, shall be delivered up and paid back by sd Horner to sd minor when he arrives to the age of 20 years. If Robert dies before sd child reaches sd age, then sd money, goods, chattels, and lands shall be paid for the use of sd child out of the estate of sd Horner.
Whatever money or property comes to Horner as Ann's part of her late husband's personal estate, if Ann dies before i Robert, Ann may dispose of the same by making a will; if she doesn't make a will, it vests in Horner; if Robert dies before Ann, full value in money for her use, during her life. The marriage took place on May 11, 1758. Sd Robert has since received from the representatives of sd Ann's late husband, Samuel Clagett, in right of Ann and her son, Samuel, exclusive of 300 ? settled upon her by her sd contract with sd Samuel Clagett, 865 ?, which he has applied to his own use. Sd Gustavus Brown, by his will, devised to Ann, for her use and support, a legacy of 100 ?, which sd Robert has also received or is about to receive, to his own use. Ann has relinquished her right of dower in deeds entered into by Robert involving 3 tracts of land, and 16 acres which belonged to Robert, lying in CC. Ann hereby releases to Robert any claim she might have to Robert's own particular estate, saving her own particular fortune. Several of the Negroes herein after mentioned are under mortgage, as well as the other personal estate, for the security of several sums of money due to several persons.
Now this deed witnesses that sd Robert Horner, for and in consideration of the marriage contract and all the afd premises and for 100 ? to Robert in hand paid by Richard Brown, Thomas John Claggett, and Cuthbert Bullet, has sold to sd Richard, Thomas, and Cuthbert, the following slaves, goods, and chattels, to wit, Quibus, yellow Jack, Leverpool, Adam, Peter, Moses, Rexum, Eolakie, Juda, Ben Sr, Ben Jr, old Jack, Samba, Hensey, Suckey, Phillis, Kate, Nell, yellow Charity, Nanny, Cloo, Mock, Pegg, Nancy, Moll, Black Charity, saran, Tom, and Jenny children of Nell, Harey, Jenny and Liza children of yellow Charity, Dick and Letty children of Black Charity Ledd Bett and Mock children of Phillis, Samara and Nell children of Mock Celia daughter to Pegg, Harry son of Nancy Isaac child of Henny, 1 quart with tankard, 1 large chaiste teapot, cream jug, silver and pint can of silver, 9 silver table spoons, 1 sil'v'er dividing spoon, 1 silver butter boat .. 12 plain China plates, 3 large hard mettle dishes, 12 water plates, 1 lot of hard metal dishes, 60 cattle, 1 bay stallion, 1 grey gelding, 1 bay gelding, 3 mares and colt, 1 sloop and 1 mahogany table and a riding chair.
Sd Richard, Thomas, and Cuthbert shall sell and dispose of so many of the mortgaged slaves, goods, and chattels out of each mortgage, and not the one for the other unless at the request of Ann, as shall be sufficient to discharge the several encumbrances and mortgages upon the same, and then sell and dispose of the residue of sd slaves, goods, and chattels .. be sufficient to raise the afd sum of 865 ? out of which 565 ? shall be laid out in the purchase of lands, slaves, and other goods and chattels, to be vested in sd Richard, Thomas, and Cuthbert, in trust for the use and maintenance of Ann, during her natural life, free from the claim of Robert, and after the death of Ann, to such persons as Ann, in her will, shall direct, and for lack of such will, then to the use of Robert and such children as he may have by Ann, during the natural life of Robert, and after his death, to the use of sd children, to be equally divided between them. If the slaves and effects shall more than discharge the mortgages and raise the 865 ?, then Richard, Thomas, and Cuthbert shall only sell sufficient to -raise 865 ?, and reconvey the overplus to sd Horner. [95] Ann, the youngest, came from a family of nine sisters, five of which married clergymen. Even after the sisters were married and well into their adulthood, they were known as "The Nine Miss Browns".

I, Ann Hanson of Fauquier County in the state of Virginia, though infirm in body, being of as sound judgment and understanding as in my ordinary health do make and ordain this my last will and testament Viz.
To son Samuel Clagett, all that tract or parcel of land I bought of my son Gustavus Brown Horner, lying in Fauquier County and containing 300 acres.
To son Samuel Clagett one other tract or parcel of land which I bought of a certain George Dodson containing 114 acres more or less and one adjoining to the before mentioned tract.
I give the above mentioned lands to my son Samuel Clagett his heirs and assigns as an act of Justice because he sustained much loss by my second marriage.
To grandson William Edmunds Horner, son of William Horner my house and lott of ground lying at Fauquier Court House with all its a appurtenances to him his heirs and assigns forever.
Whereas my son Gustavus Brown Horner has given bond for a sum of money due to myself and children by Robert Horner, I give my share of the said bond both principal and interest to my son Gustavus Brown Horner and whereas I have a bond given by my son William Horner for a considerable sum of tobacco I give the said bond both principal and interest to my said son William Horner.
To son John Horner, 50 pounds Virginia currency
Understanding that Susannah W. Harris {wife of John A. Harris} grand-daughter of my late husband Samuel Hanson is needy, I give her sole use, and not under the control of her husband, the sum of 50 pounds current money of Maryland. I do this as a return for any expense my late husband Samuel Hanson may have been at on account of my children.
To son Gustavus Brown Horner, my universal bible, and a large gold ring with a stone under which same of my sister Threlkelds heirs is set.
To Ann Hanson, daughter of Col. Samuel Hanson of Georgetown, my silver shoe buckles set with stone and my gold sleeve buttons.
To Mary Horner, wife of my son William, my suit of black satin
To Frances Horner, wife of my son Gustavus Brown Horner, my black satin cloak and my laced head clothes.
To granddaughters, Frances Horner, Elizabeth Horner and Catharine Horner a tambour muslin gown and all my remaining silk cloaths.
To daughters of son Samuel Clagett, all my remaining cloaths.
As I own no debts, I expect there will be money sufficient to pay off all the above mentioned legacies, but in case it should be found deficient, it is my will that such deficiency shall be made good out of the rents arising from the lands bequeathed by me to my son Samuel Clagett.
To four sons, Samuel Clagett, Gustavus Brown Horner, John Horner, and William Horner, all the residue of my property.

[1086] William Diuguid arrived in the American Colonies before 1745.
Albermarle Country Order book for 1744/45, p. 49,
"William Diuguid, John Hunter and Alexander Reed, having produced sommission from the Honorables and Lieutenant, and ... etc. Severally took the usualy oaths to the Governor and suscribed the test and C."
William Diuguid, our immigrant ancestor, was born in Aberdeen, Scotland on 26 Feb. 1717, the son of William Diuguid and his wife, Jean Henry (Aberdeen Old Parochial Register). He died in Buckingham Co., Va. on 22 March 1764.
In records of Augusta Co., Va. 1745 - 1800 by Chalkley is written ''(403) John Dailey vs. William Diuguid. Abates by death of defendant 22 March 1764."
He married on 25 Nov. 1745, Ann Moss (Goochland Co., Va. records) born 30 Sept. 1724 (St. Peters Register, New Kent Co., Va.) and died in 1805 in Powhatan Co, Va. (Tax records).
Albermarle Co. VA became Buckingham Co. in 1761 and Appomattox Co. in 1845.
[1155] BIOGRAPHY: Ann Moss was the only child [sic] of Alexander Moss (Will proved in Cumberland Co., Va.. later Powhatan Co. in 1772) and his wife, Elizabeth Clopton (Walker), born before 1682 (York Co., Va. records, Deed Book Vll, pg- 55). Elizabeth Clopton was the widow of William Walker who died 12 Sept. 1718 (St. Peters Parish Reg., New Kent Co., VA.) She was a daughter of William Clopton Gent. who was born in 1655 in County Essex, England. He was a son of Rev. William Clopton of Eastwood Co., Essex, and his wife, Elizabeth Sutcliffe. The Clopton line has been traced back to Edward I, King of England. It has been written that Sir Walter Clopton, one of our ancestors, signed the Magna Carta on 15 June 1215 In this the rights of the subjects are compelled to be respected by the authority and these rights proclaimed are a part of the constitution of every English speaking people. Kentwell Hall was the name of the Manor House of the Clopton Family in England.
William Clopton, son of Elizabeth Clopton, must have been in Virginia by 1673 since his marriage to Am Booth, daughter of Robert Booth, occurred about that time. Am Booth was born in 1647 Her father, Robert Booth, was Clerk of York Co., Va. and a member of the House of Burgessess 1653-54. She was formerly the wife of Capt. Thomas Dennett whose will was proved 1 Aug. 1673, by whom she had four children.
[1151] George Diuguid, is the third-son and youngest child of William Diuguid, the immigrant, and Ann Moss. He was born two years before his father died (1764), in Oct. 1762 in Buckingham Co., Va. He died in Campbell Co., Va. on 25 Aug. 1838 (date of temination of his pension). He married Nancy Sampson on 9 Nov. 1784. She was born prior to 1765 (Census 1810 Buckingham Co., Va. lists her age as 45 or over). They are buried in Campbell Co., VA.
George Diuguid was born in Buckingham Co., Va. Sometime after the death of his father William Diuguid, his mother Ann Moss moved with him to Powhatan Co., Va. where she grew up and where her father, Alexander Moss, had willed her the homeplace. This will made in Cumberland Co., Va. before the property was annexed by Powhatan Co. (probated 27 April 1772). It also willed to George Diuguid, his grandson, 30 acres of his plantation and all of his farms, houses and woodlands "lying in Great Britain which I am now possessed of when he is 21", with the proviso that if he cannot establish a right to the estate in England, he is to share equally with the other grandchildren in the remainder of testator's estate.
There is no record as to whether George was able to establish his claim to the property in Great Britain when he became 21 years of age in 1783 but given the fact that the Revolutioniary War had just ended, it is highly unlikely that he could successfully lay claim to property at that time in England. According to his application for his Revolutionary War pension, he was either 14 or 15 years old when he volunteered for duty.
The cemetery is located on Rt. 703, 2 miles NE of Spout Spring, Campbell, VA, on present Coleman farm (formerly the Patteson farm).

Alva Phelps was born in 1813 in Pennsylvania. He and his wife Margaret Robison, with several small children, were part of the exodus across Iowa. Alva enlisted in the Mormon Battalion. Margaret later provided a vivid description of that time, and especially of the conditions during the winter of 1846-47 which she spent with her children in Winter Quarters. Alva's call to join the Mormon Battalion came quite suddenly:
"We were traveling when the call came for him to leave us. It was midnight when we were awakened from our slumbers with the painful news that we were to be left homeless, without a protector. I was very ill at the time, my children all small, my babe also extremely sick; but the call was pressing; there was not time for any provisions to be made for wife or children; no time for tears; regret was unavailing. He started in the morning. I watched him from my wagon-bed till his loved form was lost in the distance; it was my last sight of him."
Alva grew ill during the Battalion march; the camp doctor, who not a member of the Church, was described as being quite unfriendly to the Mormon soldiers:
"Earlier in the afternoon he begged the doctor not to give him medicine. Dr. Sanderson, using horrible oaths, forced it down in his rusty spoon. A few hours later Alva died. The general feeling was that the doctor killed him." (Ricketts, _The Mormon Battalion_, p. 54.) Alva died on September 16, 1846, on the Arkansas river in Kansas, and was buried in a shallow grave. His widow recorded the pitiful conditions she was left in:
"Two months from the day of his enlistment, the sad news of my bereavement arrived. This blow entirely prostrated me; but I had just embarked upon the sea of my troubles; winter found me bedridden, destitute, in a wretched hovel which was built upon a hillside; the season was one of constant rain; the situation of the hovel and its openness gave free access to the piercing winds and water flowed over the dirt floor, converting it into mud two or three inches deep; no wood but what my little ones picked up around the fences, so green it filled the room with smoke; the rain dropping and wetting the bed which I was powerless to leave; no relative to cheer or comfort me, a stranger away from all who ever loved me; my neighbors could do but little; their own troubles and destitution engrossing their time; my little daughter of seven my only help; no eye to witness my suffering but the pitying one of God -- He did not desert me.
"Spring brought some alleviation from my sufferings; yet one pan of meal was my all, my earthly store of provisions. I found sale for the leaders of my team. The long, dreary winter had passed, and, although it was many months before health and comparative comfort were my portion, still I thank the Lord this was the darkest part of my life."
Margaret later completed the journey to Utah, where her children married and raised their children in remembrance of their dedicated grandparents.
